Nederlandse Online Gokassociatie Waarschuwt Tegen de Risico's van Nieuw Voorgestelde Slot- en Reclameverboden

Following a recent vote by the Dutch House of Representatives, proposed bans on online slots and targeted gambling advertising have raised concerns among the Dutch Online Gambling Association (NOGA) about increasing risks from the black market.

The Proposal and its Consequences

On April 16, 2024, the Dutch House of Representatives voted to ban targeted advertising and "high-risk" online gambling activities, including slots. This decision, part of broader regulatory changes, aims to mitigate gambling addiction and protect consumers. However, the changes still require legal approval from Minister Franc Weerwind before they become law.

NOGA's Position and Concerns

NOGA has openly criticized the proposed bans, labeling them “rash and irresponsible.” Peter-Paul de Goeij, director of NOGA, raised concerns about the potential of these bans to drive Dutch gamblers to unregulated offshore operators, complicating efforts to protect players. De Goeij argues that these measures may not only fail to protect players, but may also unintentionally blur the distinction between legal and illegal gambling platforms.

Previous Legislative Attempts and Results

Previous legislative attempts to completely ban gambling advertising were unsuccessful. However, the new motions led by MP Michiel van Nispen have been more successful. Although 90% of Dutch players currently use legal gambling services, NOGA fears that the new restrictions could significantly change player behavior, pushing them towards less regulated spaces.

Impact on Gambling Legislation

The Remote Gambling Act, the cornerstone of online gambling regulation in the Netherlands, will be evaluated later this year by the Ministry of Justice and Security. NOGA insists that decisions be based on extensive data and research, which currently needs to be reviewed for informed evaluation, according to De Goeij.

Current and Proposed Measures

The Netherlands already maintains a ban on untargeted gambling advertising and is transitioning away from sports sponsorship to limit gambling-related harm. Additional measures proposed by Minister Weerwind include intervention strategies for high-stakes gamblers and improved information about gambling risks.
